After filing the application, every trademark is examined by the examiners appointed by the Trademark Registry. After examination, an examiner issues an examination report in which the objections, if any, are raised by the examiner. On receiving the Examination Report, the applicant has to submit his/her response based on the objections in the examination report. Trademark objection is starting stages in the trademark registration process where the trademark examiner objects to your application due to certain reasons. Registrar seeks valid reasons or explanations about the mark and its registrability. The Registrar, after analyzing the trade mark application can raise objections against the application under Section 9 and/or Section 11 of the Trade Marks Act.
    There are mainly two specific reasons for trademark objection – contain incomplete/wrong information, or similar trademark already exist. Trademark examination report shall contain the reason for objection. The applicant has to file reply within 30 days from the examination report. Generally, this examination report will be communicated to the trademark agent for action. If the reply to the examination report found satisfactory, the Registrar shall proceed to accept the application and will advertise the same on Trademark Journal. If the applicant failed to reply to the registrar, then the trademark would be marked as abandoned.
